The Oklahoma Tea Party has decided that it would like to form an armed militia to defend Oklahoma against “infringements” by the Federal Government. They claim to have lawmakers on their side.
OKLAHOMA CITY — Frustrated by recent political setbacks, tea party leaders and some conservative members of the Oklahoma Legislature say they would like to create a new volunteer militia to help defend against what they believe are improper federal infringements on state sovereignty.
Tea party movement leaders say they've discussed the idea with several supportive lawmakers and hope to get legislation next year to recognize a new volunteer force. [……]
The question begs to be asked…is the wind sweeping through their ears? Is this even legal?
Not according to the U.S. Code via Cornell (law school):
TITLE 18 > PART I > CHAPTER 115 > § 2384
§ 2384. Seditious conspiracy

If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.
